Refresh Membership Terms & Conditions

PRIVACY & CONFIDENTIALITY
Given the sensitive nature of the work we do and the high level of trust it requires of our clients to place in us, you can be assured of absolute privacy when working together. As a member of the National Association of Professional Organizers, we adhere strictly to its Code of Ethics which emphasizes confidentiality, honesty, and integrity.

SERVICE AREA & RESTRICTIONS
LESS does not charge travel fees for any jobs within the 30-mile radius of our headquarters located in College Grove, TN. In the event that traveling outside of the 30-mile service area radius is required, travel fees will apply at the discretion of LESS. Our travel fees are billed at the hourly rate of $110 per hour. 

REFRESH MEMBERSHIPS, TERMS OF PAYMENT, & FEES
All Membership fees will be billed and automatically withdrawn from Clients’ accounts or enrolled forms of payment through Stripe each month. Clients will add their banking or card information via our secure payment system, Stripe. If the Client wishes to pay for a year in full and this payment option is not available online, a check can be paid to the order of “LESS, LLC".
There will be a charge of $35 for any check returned for insufficient funds, as well as additional collection and/or legal fees to compensate for overdraft charges and unpaid account balances.
All quarterly, bi-monthly, and monthly Refresh Membership services require an 1 year minimum commitment.
Clients must give written notice to amy@lessisliving.com at least 30 days prior to the desired cancellation date.

Each organizer on the job counts as one organizing hour. (Example: A 6 hour membership with two organizers would be 3 hours total. With one organizer, it would be 6 hours total).


EXPENSES
Direct expenses relating to the services provided -- including, but not limited to, shipping fees/delivery charges, parking, tolls, and other transportation charges, overnight charges -- are the Client's responsibility. They will be billed to the Client at the time of service, if not provided directly by the Client.

SUPPLIES
Clients are responsible for paying for all supplies (file folders, labels, labeling tape, storage containers, shelving, etc.) necessary for the completion of the project. "LESS" will shop and purchase supplies without the Client being present and make arrangements to have those supplies delivered to Client's location if needed. Any additional shopping with a client present will be charged the hourly package rate.

CANCELLATIONS & REFRESH MEMBERSHIP HOURS 
When a Client books an appointment with us, that time is reserved exclusively for him/her and becomes unavailable for anyone else to use. Due to reduced pricing with membership, unused hours can not be transferred to the next month and can not be rescheduled. **IF A NEED ARISES WHERE A SESSION MUST BE CANCELLED OR RESCHEDULED, please allow 5 business days, and we will try our best to accommodate. We only allow certain days for Refresh Membership sessions, and these are booked months in advance so spots are limited. 
Clients must give written notice to amy@lessisliving.com 30 days prior to the desired cancellation date in the event that a client would like to cancel their membership after their 1 year minimum commitment has been fulfilled.

CONTROL & ACCESS TO JOB SITE
Clients acknowledge control of the job site and agree to provide LESS organizers access to the job site for the term of the work. The inability to enter an agreed-upon location which results in canceling the particular session will result in a loss of that scheduled time.


TERMINATION & OBLIGATIONS
LESS, LLC reserves the right to terminate and withdraw from an organizing project at any time for reasons or circumstances including but not limited to the following: 
- Unsafe working conditions
- Failure to uphold general obligations and/or failure to communicate with the LESS team both effectively and respectfully.
- Breach of contracts and agreements with LESS (late payments, bounced checks, non-payment, etc.), or if LESS is unable to render the services requested by Client through no fault of LESS.

PERFORMANCE & DELIVERY GUARANTEE
We will not throw anything away without the Client's permission. We will help the Client make decisions, but the final decision is always his/hers. Thus, the Client is responsible for any loss or damage resulting from the discarding or destroying of any records or personal items. The Client agrees to make final decisions about the disposition of items.  All electronics containing sensitive material, as well as any prescription medicines, are to be disposed of by Client. 
In the event that we fail to meet your expectations, the client must submit a written claim within seven business days.
Failure to make a claim within seven business days implies that the Client fully accepts the completed work.
Once your claim has been received by LESS, we will reach out to schedule an appointment to discuss and evaluate any concerns.  Upon evaluation, any further action will be taken at the discretion of LESS.  
At no time will a refund be given for work or portions of a package completed to the Client's satisfaction.
All claims must be submitted in writing within seven business days of completion of the project. Letters describing in detail what work or parts of the project were not completed or satisfactorily executed should be mailed Return Receipt requested to:

REASONABLE CARE
We will use reasonable care in the performance of all of our duties. We will not accept responsibility for any damage to a Client's personal property that is not the direct result of our own gross negligence. If applicable, you are responsible for furnishing a list of specific items you do not want to be touched or relocated. In the fulfillment of organizing services provided, Clients agree to hold LESS, LLC harmless and give full discretion in the removal and disposal of papers, files and/or other property belonging to the Client. If you would like a receipt for donated items,  please make this request before we remove donations from the job site. We can not guarantee the amount of any tax deduction you may claim from any donations. 
Clients agree to limit aggregate liability to the amount of fees charged.

COMPENSATION TERMS
Clients agree to all compensation terms: payment in advance, methods of payment we accept, bad check fees and costs of collection.

INTELLECTUAL PROPERTY RIGHTS
Clients acknowledge my intellectual property rights and agree not to violate them in any way.

TESTIMONIALS
Clients give me permission to use, without remuneration, testimonials and photos of work within the home in my marketing materials, which may include print and online advertising. Clients will not be identified by name unless mutually agreed upon. We warrant that at no time will your photos or name be used to promote unlawful or morally objectionable activities, including (but not limited to): sending unsolicited email; activities designed to defame, embarrass, harm or abuse third parties; or hate crimes of any kind. Your personal information will never be sold or distributed.

IMPORTANT LEGAL INFORMATION
Agreements with my Clients are not transferable to third parties without our written permission.
The foregoing terms and conditions are governed by the laws of the State of Tennessee. Any and all legal action(s) related to this, and any agreements with our Clients may only be brought in courts located in the Middle TN area. In the event a Client breaches this Agreement and either party takes legal action of any kind,  Client shall be responsible for all costs of collection of fees, including but not limited to attorney’s fees and all expenses.
